On August 29, 2022, Regulation (EU) 2022/1031 of the European Parliament and of the Council came into force, or the International Procurement Act - IPI, which the European Union member states apply directly and immediately after its adoption.
Regulation (EU) 2022/1031 of the European Parliament and of the Council of 23 June 2022 on the access of third-country economic operators, goods and services to the Union’s public procurement and concession markets and procedures supporting negotiations on access of Union economic operators, goods and services to the public procurement and concession markets of third countries (International Procurement Instrument – IPI)
This regulation enables the European Commission to introduce IPI measures regarding measures or practices of third countries to restrict the access of third country economic operators, goods or services to the public procurement procedures of the European Union. The IPI measure is a measure adopted by the European Commission in accordance with this regulation, which will be announced by publication in the Official Journal of the European Union, while the contracting authorities of the member states will have to apply the IPI measures in relation to these third countries.
Currently, the European Commission has not yet introduced any IPI measures. The investigation is conducted within 9 months (can be extended by 5 months) and after the decision is made, it is published in the Official Journal of the European Union.
